Welcome to Morse ("we", "our", or "us"). These Terms of Use ("Terms") govern your access to and use of the Morse publishing platform, including the website, publications, newsletters, and any related services (collectively, the "Services"). By creating an account, publishing content, subscribing to a publication, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
Morse is a publishing platform that enables writers ("Writers") to publish posts and deliver them by email to their subscribers ("Readers", and together with Writers, "Users"). Morse provides the tools and infrastructure for publishing and delivery; the content of each publication is supplied by its Writer. Morse does not write, edit, endorse, or take responsibility for the content of any publication.
You are solely responsible for the content you create, upload, publish, or otherwise make available through the Services ("User Content"). You retain all rights you hold in your User Content.
By making User Content available, you represent and warrant that it complies with all applicable laws, regulations, and rules in every jurisdiction in which it is published, delivered, or received, including without limitation laws governing defamation, intellectual property, privacy, data protection, harassment, and public order.
You agree not to publish or distribute through the Services any content that is unlawful, defamatory, infringing, fraudulent, deceptive, obscene, or that incites violence, hatred, or any criminal act.
Disclaimer. Morse is a platform provider and not the author or publisher of any User Content. The views and opinions expressed in any publication belong solely to its Writer and do not represent the views or opinions of Morse, its owners, employees, contractors, or affiliates (collectively, the "Morse Parties").
To the fullest extent permitted by law, any unlawful, defamatory, infringing, or otherwise improper content published by a Writer is the sole responsibility of that Writer. Such content is not authored, reviewed, approved, endorsed, or adopted by Morse, and it is in no way attributable to Morse or its staff. The Morse Parties disclaim all liability arising from or relating to User Content, including without limitation any claims, damages, losses, fines, or penalties brought by any person, authority, or court of competent jurisdiction in connection with User Content that violates any law.
Nothing in these Terms, or in any User Content, creates any agency, partnership, or employment relationship between the Morse Parties and any Writer or Reader.
You agree to indemnify, defend, and hold harmless the Morse Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your User Content; (b) your use of the Services; (c) your violation of these Terms; or (d) your violation of any law, regulation, or the rights of any third party.
Writers may offer paid subscriptions to their publications. Payments are processed by Stripe, a third-party payment processor. By purchasing a paid subscription, you agree to Stripe's terms and to the price and billing terms shown at checkout. Subscription fees are paid to the Writer; Morse charges the Writer a platform fee.
The Services themselves, including the Morse name, logo, design, and software, are the property of Morse or its licensors and are protected by intellectual property laws. These Terms do not grant you any right in the Services except the limited right to use them in accordance with these Terms.
Morse reserves the sole and ultimate discretion, without prior notice and without any obligation to provide reasons, to suspend, restrict, or permanently remove any User's account and to withhold, remove, or disable any User Content that, in Morse's determination, violates any applicable local, national, or international law, these Terms, or Morse's Community Guidelines, or that otherwise exposes Morse or its Users to legal or reputational risk. Such action may be taken at any time, including in response to a complaint, court order, or request from a competent authority.
The Morse Parties will not be liable for any financial loss, lost revenue, loss of subscribers, loss of data, or any other damages of any kind that a User may suffer, directly or indirectly, as a result of the suspension or removal of their account or User Content under this Section. Upon permanent removal of an account, the User's right to use the Services ceases immediately.
You may stop using the Services and delete your account at any time via the Settings page. Sections that by their nature should survive termination (including Sections 4, 5, 6, and 10) will survive.
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, and in addition to the limitation in Section 9, the Morse Parties will not be liable for any financial loss whatsoever, nor for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or relating to your use of the Services, User Content, the suspension or removal of your account or content, or any third-party conduct.
We may update these Terms from time to time. We will notify you of significant changes by posting the revised Terms on this page with an updated date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
